Inherited Homes

Inherited a House in Tampa? What to Do First

Inheriting a home often comes during a hard time. Before any decision about selling, a few practical steps protect the property and the family. Here they are, in order.

The Short Answer

Start by securing the home and keeping insurance and utilities in place. Then confirm who has legal authority to sell, which depends on whether the home is in a trust, passes through probate in Hillsborough County, or transfers another way. Once that is clear, get a value and decide together whether to keep, rent or sell.

Your First 30 Days

  1. Secure the property. Lock up, consider changing locks, and remove valuables and important papers.
  2. Call the insurer. Ask about coverage while the home is vacant. Some policies limit coverage on vacant homes.
  3. Keep utilities on. Power and water help prevent humidity, mold and plumbing problems in Tampa’s climate.
  4. Forward the mail to catch tax bills, HOA notices and mortgage statements.
  5. List ongoing obligations: mortgage, property taxes, HOA dues and any assessments.
  6. Find key documents: deed, will or trust, tax bills and insurance policies.

Who Can Sell the Home?

Held in a trust

The successor trustee can usually manage and sell the home under the trust’s terms, often without probate.

Through probate

A personal representative appointed by the court typically handles the sale. Florida has simplified procedures for some smaller estates.

Florida has special rules for homestead property that can affect who inherits and how a sale proceeds. Talk with a Florida probate attorney before listing or signing a contract. This guide is general information, not legal advice.

Keep, Rent or Sell?

Keep

Consider taxes, insurance, maintenance and who will manage the home.

Rent

Rental income comes with landlord responsibilities, possible repairs and insurance changes.

Sell

Often the simplest path when there are several heirs or no one lives nearby. A home value estimate gives everyone the same starting point.

With several heirs, agree early on timeline, price range and who makes decisions. A short written plan prevents delays.

Preparing an Inherited Home

Selling From Out of State

Many heirs live elsewhere. A local Realtor can coordinate access, cleanouts, vendors, repairs, photos, showings and closing paperwork, so the sale can move forward without repeated trips to Tampa.

Frequently Asked Questions

Do I need probate to sell an inherited house in Florida?

Not always. It depends on how the home was titled, whether there is a trust, and the estate. A Florida probate attorney can tell you what applies.

Should I keep paying the mortgage?

Generally, keeping payments current protects the property while the estate is settled. Discuss it with the estate’s attorney and the lender.

Can I sell an inherited home as-is?

Yes. Many inherited homes sell as-is, with disclosure of known material issues.

How long does it take?

It depends on the legal process and the home’s condition. Once someone has authority to sell, the sale itself often follows a normal timeline.
